Terms & Conditions and Code of Ethics

INTRODUCTION & ACCEPTANCE OF TERMS

These Terms & Conditions and Code of Ethics form a binding agreement between Nordic K9 Conditioning AS (“the Company”) and students enrolled in the Elite K9 Athlete Program (“you,” “student,” or “member”). If you do not agree to these terms, please do not access the program. For any questions before enrolling, please contact us at support@nordicfitk9.com.

1. PROGRAM OVERVIEW & WHAT'S INCLUDED

The Elite K9 Athlete Program is a comprehensive 12-month canine fitness and conditioning program. Enrollment includes the following:

 

  12-month access to the Elite K9 Athlete course

  12-month access to the Canine Conditioning 101 course

  12-month access to the Nordic K9 Conditioning Academy online resources

  Live, online monthly group coaching calls for 12 months

  Jump Start Orientation Session

  3 virtual private coaching sessions

  Access to exclusive online community groups

  Email support between one-on-one coaching sessions

  Access to all online bonus resources for the duration of the program

  Bonus course content covering massage, canine anatomy, and canine sport nutrition

  Eligibility to apply to the Elite K9 Athlete Certification Practicum upon successful program completion

 

All program inclusions are subject to continued active enrollment and compliance with these Terms & Conditions.

2. PROGRAM REQUIREMENTS & TIMELINE

Program Duration:

Your enrollment includes 12 months of access to the Elite K9 Athlete Program. Graduates who wish to maintain access to the online academy, educational content, and ongoing community support may continue through our optional Elite K9 Athlete Alumnae Program.

 

Private Coaching Sessions:

All 3 private coaching sessions must be used within 12 months of your enrollment date. Unused sessions cannot be carried over or reimbursed after this period. Additional coaching sessions may be purchased at a discounted rate if required.

 

Certification — Certified Canine Athlete Specialist (CCAS):

To become a Certified Canine Athlete Specialist (CCAS), you must successfully complete all Elite K9 Athlete Program coursework and then apply to the Elite K9 Athlete Practicum. There is an additional fee to enrol in the Practicum. Certification is awarded only upon successful completion of both the Elite K9 Athlete Program and the Practicum.

 

Continuing Education Units (CEUs):

Graduates of the Elite K9 Athlete Program may be eligible to apply for Continuing Education Units (CEUs) through Colorado State University Pueblo (CSU Pueblo). CEUs and associated transcripts and certificates are issued solely by CSU Pueblo as the awarding institution and are contingent upon a current Memorandum of Understanding between CSU Pueblo and Northeast K9 Conditioning. To receive CEUs, graduates must register directly through CSU Pueblo’s registration portal.

3. ACCESS & INTELLECTUAL PROPERTY

All course content, videos, training materials, presentations, handouts, written resources, graphics, and other materials made available through the Elite K9 Athlete Program (collectively the “Content”) are protected by copyright and intellectual property law. The Content is owned by or licensed to Nordic K9 Conditioning AS and/or its licensors and is made available to you solely for your personal, non-commercial use.

 

Your enrollment grants you a limited, non-exclusive, non-transferable, personal licence to access and use the Content for the duration of your program. This licence does not permit you to:

  Copy, reproduce, republish, upload, post, or distribute any Content

  Share your account login details or provide access to any third party

  Use Content for any commercial, public, or teaching purpose without express written permission

  Modify, adapt, or create derivative works from the Content

  Remove any copyright, trademark, or other proprietary notices

 

Module Action Guides, presentation PDF slides, and Additional Resources documents may be downloaded for your own personal reference only and may not be shared, distributed, or republished in any form.

 

Any unauthorised use of Content may constitute a violation of copyright law and may result in immediate termination of your program access without refund and could also lead to persecution under Norwegian law.

4. PAYMENT TERMS

Program fees are due as agreed at the time of enrollment. All payments are processed securely through our payment provider. By completing your enrollment payment, you authorise us to charge the applicable fees to your chosen payment method.

 

Payment Plans:

Where a payment plan has been agreed, you are responsible for ensuring all scheduled payments are made on time. Enrollment in a payment plan does not reduce the total amount owed.

 

Failed or Late Payments:

If a payment fails or is not resolved within 7 days of notification, access to all online content, program resources, and coaching sessions will be suspended until the outstanding payment is fulfilled. No refund will be issued for any period of suspended access.

5. REFUND POLICY

We are committed to delivering a high-quality program and want you to feel confident in your enrollment.

 

14-Day Satisfaction Guarantee:

If you feel the Elite K9 Athlete Program does not meet your expectations of quality and value, you may request a refund within 14 days of your initial payment. Refund requests must be submitted in writing to support@nordicfitk9.com within this period. Approved refunds will be processed within 10 business days.

 

Orientation & Processing Fee:

Where a Jump Start Orientation Session or any one-on-one coaching sessions have already taken place within the 14-day period, a fee representing the proportionate value of that delivered service will be deducted from your refund. This is consistent with your rights under Angrerettloven §26, which provides that you pay for services already delivered when withdrawing from a service contract.

 

After 14 Days:

No refund will be issued after 14 days of enrollment. Unused coaching sessions within a package are non-refundable after this period.

 

Certification Practicum:

Fees paid for the Elite K9 Athlete Certification Practicum are non-refundable once access has been granted.

6. RIGHT OF WITHDRAWAL (NORWEGIAN & EEA CONSUMERS)

If you are a consumer purchasing for personal, non-business purposes, you have the statutory right to withdraw from this agreement within 14 days of enrollment without giving any reason, in accordance with the Norwegian Right of Withdrawal Act (Angrerettloven).

 

To exercise your right of withdrawal, please send a clear written statement to support@nordicfitk9.com before the 14-day period expires. A standard withdrawal form is available upon request, though any clear written statement is sufficient.

 

Where program access has been granted and services such as the Orientation Session have commenced within the 14-day period, your refund will be proportionate to the unused portion of the program, in accordance with Angrerettloven §26. We will process any applicable refund within 14 days of receiving your withdrawal notification, using the same payment method as your original transaction.

 

These rights apply to consumers in Norway and the EEA and do not limit any additional statutory rights you may have under Norwegian consumer protection law.

7. ACADEMIC INTEGRITY & PLAGIARISM

All work submitted for program assignments and certification must be entirely your own. Academic integrity is taken seriously and any form of plagiarism or unauthorised use of another person’s work may result in immediate failure of the relevant assignment, suspension from the program, or permanent expulsion without refund.

 

Plagiarism includes but is not limited to:

  Presenting another person’s words, ideas, or work as your own

  Copying text, images, graphics, videos, or audio content from any source without proper attribution

  Reproducing or republishing any Content from the Nordic K9 Conditioning Academy platform without express written permission

  Submitting work that has been substantially generated, paraphrased, or adapted from another source without acknowledgment

 

All Content shared through the Nordic K9 Conditioning Academy platform is protected by copyright law. Any reproduction or republication of program materials, in whole or in part, is strictly prohibited without the prior written consent of Nordic K9 Conditioning AS.

 

8. CANINE FITNESS & PROFESSIONAL DISCLAIMERS

All information, instruction, and resources provided through the Elite K9 Athlete Program are for informational and educational purposes only. Program content is designed to support the general fitness and conditioning of healthy dogs and is not intended as veterinary advice, diagnosis, or treatment.

 

Some injuries and health conditions may make conditioning activities unsuitable or potentially harmful for your dog. All activities undertaken with your dog should be cleared and approved by your VETERINARIAN before beginning any conditioning, massage, strength, endurance, balance, flexibility, or sport-specific training program.

 

Erica C. Boling is not a veterinarian. She and fitness instructors who teach through Nordic K9 Conditioning do not diagnose or treat illness, disease, or any canine physical or mental disorder. They do not prescribe medical treatment or pharmaceuticals. Canine massage and conditioning services are NOT a substitute for veterinary examination, diagnosis, or treatment.

 

Nordic K9 Conditioning AS and Erica C. Boling assume no liability whatsoever arising from your use of information, programs, or services provided through our online or in-person courses and programs.

 

Business & Earnings Disclaimer:

Any business coaching content, strategies, or information provided through the Elite K9 Athlete Program is not to be interpreted as a promise or guarantee of earnings or business success. Results will vary depending on individual effort, experience, knowledge, market conditions, and other factors outside our control. Nordic K9 Conditioning AS, Erica C. Boling, and program faculty make no representations or guarantees regarding income, business outcomes, or the results achieved by other students.

 

9. LIMITATION OF LIABILITY & INDEMNITY

You acknowledge the inherent risks involved in working with dogs and their owners. You accept full responsibility for your own actions and decisions in applying any knowledge, techniques, or information gained through the Elite K9 Athlete Program.

 

You agree to indemnify and hold Nordic K9 Conditioning AS, Erica C. Boling, and their respective directors, officers, employees, and agents harmless from any and all claims, damages, liabilities, costs, and expenses, including reasonable legal fees, arising from:

  Your breach of these Terms & Conditions or the Code of Ethics

  Injury to persons, animals, or property resulting from your implementation of program content

  Any representations, recommendations, or advice you give to clients, owners, or handlers

  Any actions you take in connection with canine fitness activities

 

Non-Excludable Liability:

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Norwegian law, including the Consumer Purchases Act (Forbrukerkjøpsloven) and the Marketing Control Act (markedsføringsloven §22).

 

10. ASSUMPTION OF RISK

You understand and acknowledge the inherent unpredictability of animal behaviour when working with dogs and their owners. You voluntarily assume all risks associated with canine fitness activities undertaken in connection with your program studies and any subsequent professional practice.

 

You take full personal responsibility for the health and safety of any dog in your care during program activities and acknowledge that Nordic K9 Conditioning AS and Erica C. Boling cannot be held responsible for outcomes arising from your independent professional decisions and actions.

11. GOVERNING LAW & DISPUTE RESOLUTION

These Terms & Conditions are governed by and construed in accordance with the laws of Norway. Any disputes arising from or in connection with this agreement shall be subject to the jurisdiction of the Norwegian courts.

 

For consumers resident in Norway or the EEA, these Terms do not affect your statutory rights under applicable consumer protection legislation, including Angrerettloven and Forbrukerkjøpsloven.

 

In the event of a dispute, we encourage you to contact us first at support@nordicfitk9.com. We aim to respond to all disputes within 14 days and resolve them directly wherever possible.

 

Norwegian consumers may also contact Forbrukerrådet (the Norwegian Consumer Council) at www.forbrukerradet.no, or submit a complaint through the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/

12. GENERAL LEGAL PROVISIONS

Notices:

All formal notices under this agreement must be given in writing and sent by email to support@nordicfitk9.com. Notice is deemed received when delivery is acknowledged by the receiving party.

 

Modifications:

No modification, waiver, or variation of these Terms & Conditions shall be valid unless agreed in writing and signed by both the student and an authorised representative of Nordic K9 Conditioning AS.

 

No Assignment:

Your rights and obligations under this agreement are personal to you and may not be assigned or transferred to any third party without the prior written consent of Nordic K9 Conditioning AS.

 

Severability:

If any provision of this agreement is found to be unlawful or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

 

Force Majeure:

Neither party will be liable for delays or failure to perform obligations due to circumstances beyond their reasonable control, including but not limited to natural disasters, pandemics, or government restrictions. If such circumstances persist for more than 90 days, either party may terminate this agreement by written notice.

 

Entire Agreement:

These Terms & Conditions, together with the Code of Ethics below and the general Terms of Use at nordicfitk9.com/terms, constitute the entire agreement between you and Nordic K9 Conditioning AS with respect to the Elite K9 Athlete Program and supersede all prior agreements or understandings on this subject.

 

Headings:

Section headings are included for convenience only and do not affect the interpretation of these Terms & Conditions.

13. CODE OF ETHICS & PROFESSIONAL CONDUCT

As a member of the Elite K9 Athlete Program and the Nordic K9 Conditioning Academy community, you understand that your conduct, statements, and professional practice reflect on the canine fitness industry, Nordic K9 Conditioning AS, your own business (where applicable), and yourself. By enrolling in this program, you commit to upholding the following standards of professional conduct.

Program Understanding & Scope of Practice

1.  You understand that the Elite K9 Athlete Program is designed for your own individual knowledge and personal use with your own dog(s). The Elite K9 Athlete Practicum is designed for those wishing to create and implement canine fitness programs for other dogs and owners in a professional capacity.

2.  If you become a Certified Canine Athlete Specialist (CCAS), you understand that your role is to provide educational canine fitness information and design exercise programs focused on the general wellbeing of healthy dogs only.

3.  All exercises and activities covered in the Elite K9 Athlete Program are designed for healthy dogs. You agree not to apply program content to dogs with known illness, injury, or health conditions without appropriate veterinary clearance.

Veterinary & Medical Boundaries

4.  You agree to make it clearly understood in all interactions — with clients, colleagues, friends, family, and online — that canine fitness services ARE NOT A SUBSTITUTE FOR VETERINARY MEDICINE and are not diagnostically prescriptive in nature.

5.  You agree to represent yourself accurately as a student or graduate of the Elite K9 Athlete Program. You will not represent yourself as a veterinarian or medical expert, and will not diagnose, prescribe, or administer any drug, medication, or treatment for any injury, illness, or disease.

6.  You agree not to conduct canine fitness activities for any dog unless you have received a completed and signed health history and disclaimer from the dog’s owner or handler confirming the dog is healthy and able to participate.

7.  You will only work with dogs in good health, or dogs that have received written veterinary clearance to participate in fitness activities. Where a dog has or is recovering from illness or injury, written approval from a licensed veterinarian or appropriately credentialed healthcare provider must be obtained in advance.

8.  If you have any concerns about a dog’s health, discover an injury or illness, or notice any sign of discomfort or pain, you agree to refer the dog and owner to a licensed veterinary professional immediately.

Animal Welfare

9.  The mental and physical wellbeing of all dogs is of the highest priority. You agree that if you are ever legally found guilty of animal abuse, you will immediately remove all associations, references, and connections with Nordic K9 Conditioning AS, the Elite K9 Athlete Program, and the CCAS credential, including from websites, social media, and all professional communications.

10.  Nordic K9 Conditioning AS does not support the use of weighted vests or external weights on the extremities of dogs for exercise purposes, unless this is specifically recommended and supervised by a certified canine physical therapist or veterinarian.

Intellectual Property & Copyright

11.  All materials, videos, handouts, presentations, and resources shared through the Nordic K9 Conditioning Academy platform are protected by copyright law. Any reproduction, republication, or distribution of these materials, in whole or in part, is strictly prohibited without the prior written consent of Nordic K9 Conditioning AS.

Responsibility & Indemnity

12.  You understand the inherent risks of working with dogs and their owners and take full personal responsibility for all actions and decisions you make. Canine fitness is an evolving field, and you accept responsibility for how you interpret and implement information received through the program, coaching, and all interactions with Nordic K9 Conditioning AS, its instructors, coaches, and guest speakers.

13.  You agree to indemnify and hold Nordic K9 Conditioning AS, Erica C. Boling, and their agents and employees harmless from any and all claims, damages, and expenses, including legal fees, arising from your breach of this Code of Ethics or from any actions, statements, or recommendations you make in connection with dogs, canine fitness, and dog owners or handlers.

Consequences of Breach

14.  If you fail to uphold the Code of Ethics and Professional Conduct as described above, Nordic K9 Conditioning AS reserves the right to suspend or terminate your program access. You may no longer reference your association with Nordic K9 Conditioning AS, the Elite K9 Athlete Program, or your CCAS certification (if awarded) in any professional or public context.

Data Retention

We retain your personal data for as long as necessary for the purposes it was collected, or as required by law. Purchase and transaction records are kept for a minimum of 5 years under Norwegian bookkeeping law (bokføringsloven). Account and program records are kept for the duration of your account and for a reasonable period thereafter. Marketing data is retained until you unsubscribe or withdraw consent. AGREEMENT & ACKNOWLEDGEMENT

By logging into your Nordic K9 Conditioning Academy account and accessing your program materials, you confirm that:

•  You agree to be bound by these Terms & Conditions and the Code of Ethics & Professional Conduct

•  You have read and agree to the Nordic K9 Conditioning Academy general Terms of Use & Privacy Policy at nordicfitk9.com/terms

•  You understand the scope, limitations, and requirements of the Elite K9 Athlete Program
